How to fill out a work book

A blank work book form is filled out on the basis of three documents:

  1. new employee's passport or a photocopy;
  2. document on education;
  3. job order.

The work book is issued to the person hired no later than seven days from the date of signing the relevant order. In the same period, entries are made in this document on admission / transfer to a position, awarding, advanced training.

Information about the dismissal is entered into the labor on the same day, and the document is immediately issued to the person with whom the employment relationship has been terminated.

There is no unified application form for a new work book, so the execution of the document can be arbitrary. The main thing is to indicate all the necessary details (full name and position of the head of the organization in whose name the application is written, date of compilation, full name and personal signature of the applicant), and also explain the reason for the absence of labor. As a rule, the following wording is sufficient: “I ask you to give me a new work book to replace the lost one” or “I ask you to issue me a work book in connection with the fact that I am going to work for the first time under an employment contract.”

If we are talking about issuing a duplicate work book, it is necessary to attach to it all the documents at the disposal of the employee confirming his work experience. They may be held on hand or issued by previous employers, but in any case they must be properly certified. It is prohibited to use a pre-made photocopy of a lost or damaged labor as a document confirming the length of service, even if it is notarized. Sample applications for issuing a work book to replace the lost one can be found in our database of personnel documents: unlike the application that is written when receiving a work book for the first time, it contains the wording “I am attaching documents confirming the work experience”.

Application for a new work book

Some employers are sure that in 2016 an application for a new work book at the first employment, you do not need to write: they say, and so it is clear that the employee does not have a labor. But how does the personnel officer receive information that an employee is being hired for the first time? It is most correct to demand from the applicant documentary evidence of this fact, drawn up in the form of an application. It will not be difficult to write it, but the employer will have a written justification for the decision to issue the necessary document to the new employee.

If an employee wants to receive a new labor instead of a lost or damaged one, fills out a sample application for a work book and submits a corresponding application to the personnel department, the employer does not have the right to refuse him. To verify the integrity of the employee, you can ask him to provide recommendations from previous places of employment. Since the provision of such recommendations is the right, and not the obligation of the employee, the refusal to hire due to the lack of recommendations will be considered illegal.

Application for a duplicate work book

An application for a duplicate work book is usually submitted at the last place of employment, after which the former employer, on the basis of the documents at his disposal and submitted by the employee, writes out a duplicate copy with all confirmed records. If in the previous copy of the work book there were records of transfer or dismissal, subsequently recognized as invalid, they are not included in the duplicate.

If the previous employer for some reason is not able to issue a duplicate (for example, the organization in which the employee worked is liquidated), the new employer can take care of the document. In order to obtain the missing information, without which the information on the employee's length of service reflected in the new work book will be incomplete, a request is sent to the state archive at the place of registration of previous employers, the Pension Fund or the court.
